Privacy Policy


Scope

This Privacy Policy describes how BidModo, LLC ("we" or "us") handles your personal information for our services on the BidModo website (the “Site”). By accepting the Privacy Policy and the Terms and Conditions and/or the Vendor Agreement, you expressly consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy. This Privacy Policy is effective upon acceptance for new users and is otherwise effective on November 17, 2009.

Collection of Your Information

Information You Provide Us

We allow individuals and entities ("Customers") to post information on the Site in a Job Request Form ("JRF") requesting services from vendors who have registered on the Site ("Vendors") and who will offer services to the Customers for whom they have purchased the right to bid on jobs (the "Leads"). The JRF contains information detailing the job requested by the Customer and other pertinent information that may be needed for the request ("Job Details"), and identifying information about the Customer's business (the "Customer Information"). An unlimited number of Vendors will be able to see the Job Details portion of a Customer's JRF. Up to five Vendors who have purchased the Lead can see the Customer Information and can contact the Customer to bid the job. The Customer and the Vendor of its choice may then enter into a contract for the services. Every Vendor who purchases a Lead enters into an electronic contract with us. Our contract with the Vendors prohibits them from selling a Customer's Customer Information to any third party, or using the information for any reason other than contacting the Customer to provide a bid and providing the agreed service if an agreement is reached with the Customer.

Vendors who participate in the Site must complete a form and agree to our Vendor Agreement. By doing so, the Vendor gives us permission to forward the Vendor's information to Customers for whom the Vendor purchases the Lead. We may communicate or promote the fact that the Vendor's company is a participant on the Site.

Cookies

A cookie is a small text file that is stored on a user's computer by a web browser containing bits of information such as user preferences, shopping cart contents, the identifier for a server-based session, or other data used by websites.. We use cookies on the Site to help analyze our web page flow; customize our services, content and advertising; measure promotional effectiveness, and promote trust and safety. Most cookies are "session cookies," meaning that they are automatically deleted from your hard drive once you sign out from the Site or close your web browser. We use Flash cookies, which are cookies written with Flash technology, to help ensure that your account security is not compromised and to spot irregularities in behavior to prevent your account from being fraudulently taken over.

Log files

Like many websites, we automatically collect certain information and store it in log files. This information includes IP addresses, internet service provider, browser type, operating system, referring/exit pages, date/time stamp, and clickstream data. This information does not identify individual users. We use it to administer the Site, analyze trends, track users' movements around the Site and collect demographic information about our user base as a whole.

We do not link this automatically-collected data to personally identifiable information with the exception of IP address. IP addresses are tied to personally identifiable information so we can attempt to ensure that we are not sending duplicate information to our users, and users are not spamming our system or sending erroneous bid requests.

We use a third-party tracking service that uses cookies and log files to track non-personally identifiable information about visitors to our Site in order to measure the effectiveness of our Site and recognize opportunities for improvement.

Clear Gifs

We use clear gifs in our HTML-based emails to allow us to know which emails have been opened by recipients. This allows us to measure the effectiveness of our communications and our marketing campaigns. If you would like to opt-out of these emails, please see "Choice and Opt-out" below.

Use of Your Information

Preference Reports

We may store information that we collect through cookies, log files and clear gifs, to create a report of your preferences. We may tie your Customer Information, and your purchasing history, to information in the report, in order to provide tailored promotions and marketing offers and to improve the content of the site for you.

We do not share your preference report with any third parties, although we will pass the Job Details information you provide in the JRF to our Vendors and we will provide your Customer Information to up to 5 Vendors who purchase your Lead.

Non-Identifying User Information

We may share non-identifying demographic and business information about our user base with our partners and advertisers. This information does not identify individual users. Typical information shared may include the geographic location and industries of users, number of bid requests, the frequency and types of services requested, and the size of Customers. We do not link our user non-identifying demographic and business information with personally identifiable information.

Personally identifiable information

We do not share Customer Information or any Customer’s personally identifying information except with Vendors who have purchased the Lead on specific jobs. We do not share Vendor personally identifying information with third parties without the Vendor’s consent.

Disclaimer About Our Disclosure of Your Information

We reserve the right to disclose your personally identifiable information if required to comply with a judicial proceeding, court order, or other legal process. We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that a listing or other content violates the rights of others, or protect anyone's rights, property, or safety. Such information will be disclosed in accordance with applicable laws and regulations.

Communications From Us

Special offers and updates

We may occasionally send you information on new services, special offers, and information articles/newsletters. Out of respect for your privacy, we offer you the opportunity not to receive these types of communications. Please see "Choice and Opt-out" below.

Newsletters

All users who request a quote may be added to a distribution list for our e-newsletter. Out of respect for your privacy, we provide you a way to unsubscribe. Users may opt-out of newsletters or any other communication from BidModo by clicking opt-out on the newsletter. Please see the "Choice and Opt-out" section below.

Dashboards

Each Customer will have a password protected unique page ("Profile Dashboard") on the Site on which the profiles of Vendors who have purchased the Lead on their job are posted for the Customer to view. Each Vendor will have a password protected unique page ("Vendor Dashboard") on the Site on which Job Details for which the Vendor may purchase the Lead, pricing information, and information on jobs won by the Vendor are posted, along with statistical data that can be used by the Vendor to monitor and judge the success of his BidModo participation. The Profile Dashboards and Vendor Dashboards are private to each user, except that we may use the information without identifying the user.

Ownership of Information

We are the sole owner of the information collected on the Site. We collect personally identifiable information from visitors at several different points on the Site.

Your Access to Personally Identifiable Information

You will have access to your personally identifiable information on your Profile Dashboard and may make changes to correct or update the information at any time by utilizing the Manage My Account function on your Profile Dashboard.

Links To Other Sites

This Site may contain links to other sites that we do not own or control. We are not responsible for the privacy practices of such other sites. When you leave our Site, please be aware that you are at another site and read the privacy statements of each and every website that collects personally identifiable information. This privacy statement applies only to information collected by this Site.

Security

The security of your personal information is important to us. We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input. We use AES 256 bit encryption for our SSL and follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

Your password is the key to your account. Use unique numbers, letters and special characters, and do not disclose your BidModo password to anyone. If you share a computer, be sure and sign off when you are finished. If you do share your password or your personal information with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately notify BidModo and change your password.

Business Transitions

In the event we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of our assets, your personally identifiable information will likely be among the assets transferred.

Choice / Opt-Out

If you wish not to receive our newsletter and promotional communications with educational information, announcements, and special offers, you may opt-out of receiving them by following the instructions included in each newsletter or communication.

Changes In This Privacy Policy

If we decide to change our privacy policy, we will post those changes to this privacy statement, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.
